Request USCIS to use new H4 i94 by interfiling for pending H4 EAD i765 application. Get auto extension with new i94 at border or after travel.

H4 EAD is eligible for the auto extension as per new USCIS rules .

Once you have the new H4 i94 in hand, you can send it to the USCIS via interfiling to get extended validity for the pending H4 EAD. USCIS does not ask you to send this new i94 explicitly to get an auto-EAD extension, but, we recommend it.

Interfiling is nothing but an informal process where you send the document to the USCIS service center with a cover letter that explains what you would like to do.

  • USCIS does not send any receipt or acknowledgment for interfiled documents.
  • There is no other formal process by USCIS to accept your new i94 unless they explicitly request it via an RFE (Request for Evidence).

Documents Required

Add barcodes & generate a letter, reapply h4 ead after getting a new h4 i94.

You can write a simple cover letter by typing and including all your i765 details or use the app to generate one .

The app sends you the generated letter by email. You can then print it on A4 size white (or pink/green to highlight) and then attach the following documents in this order:

  • i94 Interfile Cover Letter (Keep it on TOP).
  • H4 most recent i94 copy (paper-based or downloaded from CBP site).
  • H1B i797 approval copy.
  • H4 EAD i765 receipt copy.
  • Current H4 EAD card’s front and back side copy (even if expired).
  • Current Passport Copy (pages with photo and address).
  • Expired Passport Copy (if this new i94 is attached to this old passport number).
  • Any one current address proof (like Driving License, utility bill, etc.)

Use a paper clip or a binder to tie all the documents. Do not use a stapler.

We strongly recommend sending your i94-interfile package either by UPS, FedEx, or USPS with tracking .

You should send it to the USCIS service center where your i765 EAD application is currently pending. This address is available on the i765 receipt notice.

How to Write an i94 Cover Letter

The language in the letter by App is tried and tested and has been devised based on real-life successful cases.

The benefit of using the app is that it validates all the data and avoids mistakes thereby increasing the chances of interfiling success.

#Step 1 – Enter i765 EAD Receipt Details

Visit the USCIS i94 interfile letter app .

Click the ‘ Scan i-765 Receipt (Full Image) ‘ button. You can enter the data manually as well if you do not want to scan your USCIS i765 EAD receipt.

The app uses its AI algorithm to read the USCIS receipt you added. It will show what values were read correctly and what others could not be read reliably.

#Step 2 – Enter H4 Name & Birth Details

Your name and birth date would be pre-filled if it was found in the scanned USCIS receipt. If not, then you can enter or edit manually.

#Step 3 – Enter your A number

Again, if the A-number was read from your i765 receipt, it will appear here.

If you do not know your ‘ A-number ‘, then you can leave it blank here.

#Step 4 – USA Last Entry Status (i94)

This is the most important step where you provide your most recent i94 information.

  • Both online and paper i94 details should match if it’s the most recent i94.
  • If paper i94 does not match the online CBP i94 but it is the most recent, then use paper i94 details here.
  • If you traveled by air or sea outside the USA and then got the new i94, then download it from the CBP website .

#Step 5 – My Contact

We suggest entering the same address as you wrote on your EAD i765 application form.

If you have changed your address after filing the i765 application and then filled the AR-11 form to inform the USCIS, then use the new address here.

This should be a US mailing address.

#Step 6 – Sign & Place (Optional)

You can enter the signing date and place to be printed on the letter. If you do not fill it in the form, then you will need to write it by hand before sending it to the USCIS.

  • Sign Date : Date today or any date in the future when you want to use this document.
  • Sign Place : City or state name where you are present at the time of signing this interfile letter.

#Step 7 – Header & Footer (Optional)

This section is optional for individual users. If you are sending this letter by yourself, then we suggest leaving it blank.

It can be used by companies and/or Attorneys to print custom text on the letter header and footer.

The app also gives you the option of adding your i765 case number barcode and A number barcode to help USCIS easily scan your application.

A common question is “Do I need to Re-Apply for H4 EAD once we have got the new I94 at the border?”

The answer depends on the way H4 has been filed:

#1 H4 Extension & H4 EAD are pending

There is no need to re-apply for H4 EAD once you have got a new H4 i94 at the US land border or by way of traveling outside the US.

#2 H4 COS & H4 EAD are pending If you filed an H4 change-of-status and H4 EAD, then we strongly recommend reapplying for H4 EAD and sending the i94 interfile letter.

Why send an i94 if reapplying for H4 EAD with a new H4 i94?

Sending the new i94 to be attached to your currently pending H4 EAD may help you save USCIS processing time.

If the USCIS officer uses it or may then ignore the H4 COS application denial. Note that H4 COS will be denied since getting a new i94 automatically abandons your pending Change of status application.

The old expired passport number attached to the most recent i94 does not affect anything. Do not worry.

USCIS will not send any receipt for your interfiled i94. If they accept it, you will straightaway get EAD approval.

The USCIS officer working on your EAD case may request the new i94 if you travel or visit the land border to get a new i94. USCIS automatically gets this new travel information too through CBP. But, in some cases, they do request a new i94 by way of RFE.

You should ideally send the new H4 i94 before your current EAD card expires to be on the absolute safe side. This way, you have the proof and can use the automatic EAD extension.

It is not mandatory to send the new H4 i94 to the USCIS. Many people had gotten their H4 EAD approved even when they did not send the new H4 i94 to USCIS but some others have gotten an RFE or their EAD was denied. So, there is no one rule here. It is your choice.

What is H4 Expedite Request Process ? How does it work ?

USCIS provides Premium processing options for certain forms to get a decision from USCIS within 15 days. But, I-765 form that is used to apply for H4 EAD does not have the premium processing option. USCIS to address such forms that do not have premium processing and need faster processing, provides an option called “Expedite request”.

Anyone can apply for Expedite request based on certain criteria like severe loss to company or person, urgent humanitarian reasons, US govt. interests, or USCIS error. After applicants submit the request, USCIS evaluates them on case by case basis and approves or denies the same request. If approved, USCIS processes the expedite request immediately and you are likely to get a decision on your application within 30 days. Now that you have the background, below are experiences shared by users, who were able to expedite H4 EAD processing using various reasons like loss to company, personal loss, etc.

  • Call USCIS Contact Center at : 1-800-375-5283
  • Press 1, pause , press 1, pause 2 pause, press 2 pause, then press #
  • It took 10-20 mins to get connected to someone on Tier 1 level
  • Explain the situation and they will give an Expedite Service Request# number and a follow-up inquiry mail was sent to us and how to send the emails.  They will ask for your case number and email.

Tip : Usually wait takes 25 to 40 min, but one user was able to get hold of a agent in 5 min. When you enter the Receipt number in the Interactive Voice Response System Options, it does not let you proceed directly, it will disconnect, if you ask for agent or “speak to agent” . The trick is, change your first question to say “I want to speak about appointment”, then it will get you speak to human faster.

You need to provide a company letter which should have the request number reference and get it to be signed by company representative.

Processing time for Expedite Request :

Our request was delayed due the Holiday season. When I asked how many days to see the approval, they said normally it would normally take 7 days to respond to expedite request. But due to low number of resources (due to holidays season) it might take up-to 30 working days. Below is our timeline for the entire processing.

H4 EAD Expedite Request using Congressman & Ombudsman

Background of H4 EAD Application :

We applied H4 EAD on Sep 3, 2019 along with my husband’s H1B, went for Biometrics on Sep 30, and then upgraded all together to Premium Processing. Received RFE on Oct 9, RFE answered back on Dec 9, H1B approved on Dec 20, 2019 but no change in H4 or EAD status.

My employer was very worried and they suggested me to reach USCIS and expedite. Below is the process I followed.

Step 1:  Called USCIS to Expedite – Standard Expedite request way.  

I Called USCIS on Dec 30, 2019 to expedite.  They sent me an email to send the supporting docs after 2 hours of my call. They also mentioned to send all supporting docs as a single attachment.

Important Info on Calling :  I called Toll free number and almost every time I am on wait time more than 15 mins, but as we are waiting for a big thing we need to be patient. The voice mail clearly says which options to press, we need to follow those, I did not reach tier office anytime before my requests is expedited. After it got expedited I told Customer Service Representative to transfer the call to Tier 2 as I have medical therapy and I need to discontinue if I lose my income, after 3 unsuccessful attempts they finally forwarded. But even that Tier 2 person said you have to wait 10 days after expedite is approved.

  • On Jan 2, 2020 I raised an online request for Ombudsman to expedite..

  • I got call back from Ombudsman and I explained my situation they said they will review on Jan 03, 2020.   
  • On Jan 06, received an email from Ombudsman saying your request is denied as its under processing times.

Step 3 : Expedite Request for H4 EAD using Congressman

Also contacted Congressman online on Jan 02, 2020

Meanwhile I called Local Congressman office(California) on Jan 3, 2020.

I found the local congressman using https://www.house.gov/representatives/find-your-representative . The congressman was a House Representative

I did not visit their office, only spoke on phone. The House representative office asked me to sign a waiver and send supporting docs along with waiver to some email id. I did everything same day on Jan 03, 2020. The process can vary by state, so you need to call the Senator or House Rep in your area

A person emailed me from Congressman’s office saying I will work on your case and by EOD he said sent a request to USCIS to expedite your case.

I sent her the same documents with my offer letter + medical therapy expense(Same one I sent to USCIS). Luckily for my case she is very friendly and elped me in expedition

Expedite Request Status – Reviewing, Approved

After 3 days on Jan 8, 2020 USCIS changed status to we are reviewing your request for expedition and after 6 hours same day another status change saying expedition is approved. Expedite approved on Jan 08, 2020, Card being Produced : Jan 14, 2020

  • H1+H4+ H4 EAD applied – Sep 3 rd , 2019

No need to convince USCIS at all, it’s their process, a soon as you call for expedite request they say they will send an email to send documents in 5 days, but for me I got the same day.

Tips from my Experience of raising Expedite Requests :

In my case Congressman’s office did a very big favour. Mistake I did is as ours is upgraded to premium after Biometrics I assumed my EAD will be approved after 10 days and simply waited. I would have got my approval if I would have done it before without wasting 10 days in between.  My suggestion is don’t assume things at least on behalf of USCIS and keep moving with available resources.  My suggestion is to apply for EAD renewal as soon as possible, if you cannot because of H1B extension issues first raise the expedition with USCIS(Need to be very patient) and then with Ombudsman or Congressman. My case Ombudsman rejected saying its under processing times but Congressman did a great help.

H4 EAD Expedite Request Experience – USCIS Call, Congresswoman

Step 1 – Called USCIS for H4 EAD Expedite Request

On Jan 6th, I tried to expedite my EAD by calling in the USCIS, tried to explain that I would lose my job and also have financial loss & cannot pay my medical bills if I lose my job. He raised the request as ‘extreme emergency’. Next day it was assigned to an officer and within few hours got a rejection notice.

Step 2 : H4 Expedite using Congressman

On the very same day, Jan 6th I tried to contact my congressman to see if they can help in this case. Used this link to find congressman  https://www.govtrack.us/congress/members , this gave me 2 senators and one representative for my address. When you click on this link “official website” of senator / representative, it would redirect to their personal home page where you can raise request on various topics.

I used the representative ‘Watsen Coleman for New Jersey’  https://watsoncoleman.house.gov/  .

This website had an option Services -> Constituent Services -> Help with a Federal Agency.

It opens a form, you just fill out all your personal details, case number / date and the nature of problem -> Click generate request. It would give a printable form of the request which needs to be physically signed. It looks like below.

Additionally I also prepared a cover letter and attached few documents like

  • Letter from employer saying that they need the EAD card for me to continue employment
  • Few big medical bills which needs to be paid in next few months.

  • H1 RFE response – 19 Dec
  • H1 approved – 23 Dec
  • Expedite EAD – 6 Jan
  • EAD Expedite Request rejected – 7 Jan
  • Expedite EAD (via congressman) – 7 Jan
  • H4 EAD approved after 3 days.

Honestly, I am not sure if this request I submitted was even raised with USCIS. I did not receive any notification from congressmen about expedite request. Within 3 days my EAD case was approved and next day H4 case was also approved.

Hi, what happens if the expedite request is denied, will the application be processed under normal processing? the application will be active and we will be getting the EAD under normal processing? Or the EAD itself denied

GV3, Nothing happens. It will continue to be processed in normal processing time. No denial will happen because the expedite request was denied.

I have a situation where we are converting one status from the other . H1 to H4 . Now the h4 and EAD is filed together 2 months ago. Dec 2021. And we have the change of status applicable from September 2022. So my question is can I expedite the process in April to know make sure if I need to renew h1

Nidhi, You cannot expedite without a proper reason. If you have any situations as mentioned in How to Expedite USCIS Case – Reasons , you can try to do it.

I want to share my experience with expediting H4 and EAD processing. We called the number given in this post to reach the USCIS. We got connected immediately to the voice assistant. We tried different options such as asking to talk to an agent, asking to check appointment dates etc., as suggested above but none worked. We then told that we are calling about expediting the H4 processing. Then there were about 3 attempts of saying that we need to expedite I539, it sending an SMS about filing I539 and we then gave our story about why we want the expedite request. Then the automated assistant connected to a human who helped us creating the expedite request. I can say it was quick. You will be connected but be patient and persistent. All the best friends.

So how many months in total did it take to complete the process for h4 and ead

My Case is a bit unique. Any valuable suggestion with links will help me here. My H4 will expire by Dec 2021. However my husband has valid h1 till 2023 and since I had applied H4 EAD after h1b approval, my EAD is also valid till 2023. So I’m in a situation where I have valid H4 EAD but H4 is expiring in a month and the extension applied a few months back is still in progress. (Applied in August 2021). Some of the attorneys say I cannot work as H4 is going to expire but others say I can work as H4 EAD is valid and the H4 extension is in progress. Please suggest if you have gone through these scenarios or know what to do here. Also, can I expedite my H4?

USCIS Guidelines for H4 EAD Eligibility

Primary H1B visa holder should have an approved I-140.
If primary visa holder is on H1B status under AC21 sections 106(a) and (b) i.e. your H1B has been extended beyond 6 years and you have PERM filed (pending or approved) and I-140 filed (pending or approved) for over 365 days, then also you are eligible to file H4 EAD. I would recommend consulting your employer/ attorney for this special case.

USCIS H4 EAD Eligibility Criteria

If you are the principal beneficiary of an H1B visa holder with an approved form I-140, Immigrant Petition for Alien Worker then you are eligible for H4 EAD. For example, children (unmarried) under the age of 21 and spouses of H1B visa holders are eligible for H-4 status, and so for H4 EAD.

So if your primary visa holder is on a valid H1B status and has an approved I-140 (either from your current employer or past employer, just make sure it's not revoked by checking the status online ) and your visa type says H-4, you are good to take benefit of H-4 EAD.

H4 EAD with Pending PERM or I-140 (H1B > 6 years)

If the primary H1B visa holder has been granted an extension on H1B after six-year under the AC21 act i.e. you are in your 7th year of H1B and your PERM is pending for more than 365 days then also you can apply for H4 EAD.

If your PERM is approved but I-140 is pending, still you can apply for H4 EAD. Again for this case, please talk to your employer/attorney. This happens when there is a massive backlog in USCIS processing for PERM or I-140, sometimes it takes 1-2 years for approval.

Reference : Under AC21 § 106 , an H-1B nonimmigrant can receive H-1B status beyond the six-year maximum, in one-year increments, if 365 days or more have passed since either an application for Alien Labor Certification (Form ETA 750A-B or ETA 9089) or a petition for an immigrant worker (Form I-140) has been filed on the alien's behalf.

Once you know that you are eligible to file for H4 EAD, let us see what documents you would need to file I-765 by mail. There is no online H4 EAD application process yet, as mentioned earlier, as of now online is mainly for the F1 category only.

H4 EAD fees: The fee is $410. You can pay with a money order, personal check, or cashier’s check or by credit card using  Form G-1450 , Authorization for Credit Card Transactions. If you want to pay by personal check, cashier's check, or money order, you must make your check payable to the "U.S. Department of Homeland Security".

Recent photographs : You would need 2 passport-size recent photographs. Mention the I-94 number on the back of the photograph with a pencil. See how you can print passport-size photos using your phone .

I-765 Photo Requirement

Form I-765: The eligibility category will be c(26) for H4 EAD.

Legal status proof: You would need the most recent I-94 form and your I-797 approval notice.

Photo ID: Passport (front and back pages), visa stamp copy, or EAD copy (EAD copy is not for the first-timer, but in case you are renewing). Your DL or State ID will not work for the photo ID requirement.

Relation to primary H1B holder : A copy of your marriage certificate in English.

H4 EAD eligibility: Copy of H1B spouse's I-797 approval notice for form I-140.

Form G-1145 (optional): This will help notify you via text or email. You can download it here .

Cover letter (optional): This is also optional but it will help an officer to understand your case better. You can refer to this for writing.

Even if you are applying for renewal or extension, the above document checklist will remain the same.

Quick Tip for Renewal: If you have a USCIS notice from your last EAD, you would have received a notice with sample bar codes that can be used for extension, and that will help USCIS officers speed up your application. Please include it if you still have it. If you don't have it, it's not mandatory to include it.

I am attaching a sample check so that you can verify it. The H4 EAD fee is $410 and your check should be payable to "U.S. Department of Homeland Security". Don't forget to date and sign it. At the back of the check (optional), you can mention the applicant's I-94 number with a light pencil.

You can download the latest version of the I-765 form from the USCIS website. There is also documentation on I-765 instructions which is very simple to follow. The H4 EAD category code you need to use is c(26).

Download and print the I-765 form from the link provided. Select reason for applying: Initial permission if you are a first-timer or Renewal for extension or Replacement for lost cards.

Fill in your personal information: If you have a single name, use FNU in the given name and your actual name in the Last name. Read more about FNU's name here .

You can also apply for an SSN card if the applicant doesn't have one. Just select "No" for 13.a. and then select "Yes" for Q14 & 15 and provide your father's and mother's names in Q16 & 17.

Choose the H4 EAD eligibility category as c(26) on question 27.

Provide your signature: Sign and date the form.

Pay the filing fee: I always preferred to pay via check.

Mail: Mail the completed form with supporting documents via USPS, UPS, FedEx, etc.

I-765 filing address will depend on your eligibility category, refer to the USCIS website . Please verify the address before dispatching your documents as this might change in the future.

Wait for the USCIS decision. You can track the status here . You will receive the SSN card via mail after EAD is approved.

You will also get electronic alerts if you have filed (optional) the G-1145 form.

There are only 4 centers that process the c(26) category which is for H4 applicants and processing time might vary between 3 to 10 months depending upon which service center is processing your application.

H1B, H4 COS, and H4 EAD: You may speed up the processing of your H4 EAD if you apply for an H1B extension for the primary visa holder along with a Change of Status (COS) to H4. For detailed information, you can read more about this process here .

Expedite request: You can explore the option of expediting the H4 EAD application based on humanitarian reasons. There are no fees for this service, but the consideration of your case depends on the reason you provide and USCIS's discretion. For more details, you can read about it here .

However, you can check the current processing times on the USCIS website here . Current California service center processing time is around 6.5 months, this can change in the future.

If you send the wrong fee, USCIS will reject your application. Pay the exact fees needed.

Biometrics fees would not be required for H4 EAD.

Do not use a short abbreviation like "USCIS" while writing (payable to) the check. USCIS will reject it.

I always preferred to personal check to make payments because that way you can also see if you are application is getting processed, just keep checking your bank balance and when $410 is deducted.

If your photographs are not recent then our application will be rejected. Do not wear a white shirt/ top and the background should be off-white.

Do not forget to sign and date the form before you mail it.

While mailing the application, first keep the check on top, second, photograph in a small envelope, then form G-1145 (optional), and then I-765 and the rest of the supporting documents.

Hi, I see a correction. you have mentioned

"H4 EAD eligibility:  Copy of H1B spouse's I-797 approval notice for form I-140."

but in the instructions from the website it says below.

"Item Number 29. (c)(26) Eligibility Category. If you entered eligibility category (c)(26) in Item Number 27., provide the receipt number of your spouse’s most recent Form I-797 Notice for Form I-129 , Petition for a Nonimmigrant Worker, in the space provided."

Basically it must be the I-797 of the I-129 and not the I-140 application.

Hi Selvaganesh, It depends on what basis you are applying the H4 EAD. You can apply for H4 EAD either with an approved Form I-140 or if the H-1B principal has received an AC21 106(a) and (b) extension (7th year of H1B).

Typically, applicants apply with an approved I-140, and you will need the I-797 approval notice for I-140 . I have added the USCIS instructions link and screenshot for your reference. However, if you are applying based on an AC21 extension, you'll require the I-797 approval notice for the latest I-129 Form. Thanks.

Once you receive I-20 from University, you need to apply to change your immigration status from H4 to F1 visa. You could either travel outside the United States and get F1 visa stamped or stay back in the US and apply for a change of status from H4 to F1. You need to submit the H4 to F1 change of status petition I-539 online. The fee for Change of status is $370 as of this writing. You also need to pay $85 biometric fee. Once the form is submitted, you are required to send following supporting documents to USCIS:

  • Copy of I-20 from the University
  • Acceptance letter from the University granting you the admission
  • Copy of Sevis fee receipt. Currently Sevis fee is $200 and it can be paid online
  • Copy of most recent I-94
  • Copy of your passport – include only first page, last page, and all visa stamp pages
  • Copy of all prior I-797A approvals if you had filed any H4 visa extensions
  • Proof of funds to cover tuition and expenses. Include your H1B spouse’s bank statements for last 3 months. The bank balance should be more than the amount mentioned on I-20
  • Cover letter explaining why you are applying for the change of status from H4 to F1. Since F1 is a non-immigrant visa, you need to prove your intent to return back to your home country after completing your degree
  • Copy of your marriage certificate
  • Copy of H1B spouse’s passport – include only first page, last page, and all visa stamp pages
  • Most recent I-94 of your H1B spouse
  • Last 3 pay stubs of your H1B spouse
  • Cover letter from H1B spouse that they are sponsoring your education
