With all that activity, it's not surprising that Reddit has become a hub for digital piracy , and the site has struggled with managing copyright violations for several years. A subreddit called r/piracy (all subreddits begin with an "r/") in particular has become the focus of some unwanted attention.

While other subreddits have occasionally shared copyrighted material, the r/piracy forum is, by design, for individuals interested in the tools, techniques, and resources of online piracy.

With more than 640,000 members, it was created in 2008 with the mission of being "a community dedicated to the discussion of digital piracy," according to its own description. That you can find discussions of the vulnerabilities of piracy laws on Reddit is unsurprising.

"Google 'reddit piracy' and you'll find lots of active links, where Reddit users openly discuss the weakness and vulnerabilities of various piracy laws," said Monica Eaton-Cardone, chief operating officer of Chargebacks911. 

Given the subject matter, the piracy subreddit attempts to thread a particularly precarious needle. According to the rules of the subreddit, "submissions must be related to the discussion of digital piracy." The rules of the forum specifically prohibit activities like linking directly to pirated media, requesting activation keys, asking others to download pirated content, or asking how to pirate specific copyrighted works (though generalized conversations about pirating techniques are acceptable). 

A scan of r/piracy reveals an active community (at any given time, there are more than 1,000 users online) with threads about a diverse range of topics, including tips and tutorials on using popular tools and utilities, troubleshooting tips ("why are my 4K movies purple?"), and news about sources for copyrighted content. 

Unlike many online forums elsewhere on the internet, though, r/piracy is a moderated community (Reddit moderators are unpaid volunteers from the community) and the discourse is largely civil and on-topic. 

The state of piracy on Reddit

Reddit has been attempting to address piracy on its platform for several years, with serious efforts to mitigate copyright infringement beginning around 2019. Eaton-Cardone said, "Reddit has banned some of the more blatant abusers — /r/NFLstreams, /r/NBAstreams, /r/soccerstreams, /r/UFCstreams, /r/WWEstreams — but Reddit is one of the largest sites in the world. Policing it is extraordinarily difficult." 

Nir Kshetri, a professor at the Bryan School of Business and Economics, explained why Reddit was compelled to act: "When it was shut down, r/NBAstreams had 474,000 subscribers who could access pirated NBA content for free. The subreddit r/soccerstreams had more than 400,000 subscribers who had access to pirated soccer streams."

Rather than shutting down r/piracy outright, as happened with those other subreddits, Reddit decided in 2019 to delete all of r/piracy's posts and comments created prior to September 2018 — a decade's worth of content, erased from the Reddit archives. 

In Reddit's transparency reporting , it's clear that the platform has been increasing its content monitoring exponentially. In 2018, Reddit received 9,534 copyright notices, which resulted in 26,234 content removals. In 2019, Reddit received 34,989 copyright notices, which resulted in 124,257 content removals — nearly five times that of the year before. In 2020, Reddit received 86,866 copyright notices and removed 375,774 pieces of content — three times as many as in 2019.

Based on the takedown requests — and actual takedowns — Reddit appears to have a piracy problem, and r/piracy moderators have existential concerns about the future of their subreddit. "We are now on thin ice," moderators wrote in one post , and added that the subreddit is in jeopardy. "We definitely do not want to be banned like r/megalinks, which was a subreddit specifically tailored to providing links to pirated content."

Cleansing Reddit won't eliminate piracy

Even if members appear to follow guidelines and avoid posting links to copyrighted material, some users say that the subreddit is still a direct vector to piracy.

Will Peach, a fourth-year medical student who regularly uses the r/piracy subreddit, said, "It happens via the backdoor. Recommendations are made in various threads and then DMs [direct messages] are sent privately. Piracy happens via other portals, like Google Drive. But it almost always starts on Reddit."

Reddit moderators appear to be enforcing guidelines in hopes of staving off a full shutdown of the r/piracy subreddit, yet they're also planning for the worst.

Allan Borch, founder of the tech marketing blog Dotcom Dollar, said, "[They] already have a list of forum replacements, including rival discussion site Raddle.me." Referring to the purge of posts older than 2018, Borsh added, "Indeed, those posts 10 years in the making aren't actually gone. They've already been archived on GitHub. Piracy might move away from Reddit, but that doesn't mean it's dead."

First it was football streams, now Reddit is going after r/piracy

Reddit is trying to clean-up its act – and it's taking on illegal streaming in a big way. The move started with r/soccerstreams but has now moved to r/piracy. A decade of discussion about digital piracy is being methodically erased from the subreddit, sparked by takedown notices on two-year-old posts. No-one should expect the deletion of a few dozen links to dent piracy, though it may have a chilling effect on simply talking about it.

The r/piracy subreddit has 367,000 members and has been around for a decade. But in mid-March, the moderators received a letter from Reddit's lawyers , warning that the group risks being shut down after 74 copyright complaints via the US DMCA system. "We will be required to ban this community if you can't adequately address the problem," the letter from Reddit's lawyers reads. In response, the subreddit's moderators have started deleting any posts older than six months, in an effort to avoid any further complaints resulting in the group being banned from Reddit.

Reddit has been some of its most toxic subreddits in recent months. Groups such as r/watchpeopledie and r/incels have been removed, as have other piracy link sharing groups, including r/megalinks, r/fullmoviesonanything and r/soccerstreams. But r/piracy was trying to be different , billing itself as "a community dedicated to the discussion of digital piracy."

Links to dodgy streams or downloads are banned, with moderators and even a bot deployed to remove any that do get posted, catching about 80 per cent and relying on the community to report the rest. And plenty of the conversation is around piracy, rather than simply sharing sources.

There are discussions about feeling withdrawal if you don't pirate regularly, whether people tell their friends that they pirate, and increasing worries about copyright trolls, as well as generic tech and troubleshooting questions. But there's also — on the front page of the subreddit, despite the looming copyright complaints — plenty of requests for help finding sites for specific pirated material as well as breaking licence checks on games .

Despite its attempts to clean up and behave, r/Privacy still faces being banned by Reddit head office. The March legal letter was, according to one moderator, the first DMCA warning the group had been hit with — there were no previous warnings from Reddit or its lawyers over ten years. "Until the first official warning, we have never had any contacts from the Reddit admins about DMCA notices or any other such copyright violations," moderator dbzer0 says via Reddit's chat function. Reddit has yet to reply to our request for comment.

The letter suggests that if r/piracy is hit with more copyright complaints, it could be banned. In contrast Reddit's soccer streams page was instantly banned by the company in January.

The last chance for r/piracy makes life difficult for moderators for two reasons. First, Reddit doesn't appear to be sifting through whether the takedown demands are valid or not. According to a spreadsheet of DMCA complaints from this year shared by one r/piracy moderator, 38 posts removed in 2019 didn't all actually directly link to pirated materials. Of those included in the takedown request, 24 did feature direct links to streaming sites, but the rest did not, instead offering advice on how to install software or asking if a known streaming site was offline.

That's standard under the DMCA system thanks to a rule known as safe harbour, under which compliance keeps Reddit safe from further legal action. "If you're on the receiving end of a notice, you have a choice, " explains David Woods, a partner at law firm Pinsent Masons. Either comply, or file a counter notice and defend your position. "You may find the path of least resistance is simply to comply." That's especially true, he notes, for companies that are hit with a larger number of DMCA notices, but if DMCA complaints aren't assessed, it means r/piracy could face a ban even if its posts don't actually technically infringe copyright.

The second challenge for moderators is the r/piracy archive. One set of takedown demands from Warner Bros against r/piracy largely relate to comments in a single thread from October 2016. "Any copyright holder that wishes to file a notice can dig deep enough and find anything that's slipped in between the cracks and Reddit will gladly comply," notes another moderator, who goes by the moniker dysgraphical. "This is not pertinent to r/piracy, but rather any community."

Hence the subreddit's deletion spree. Anything older than six months is being scrubbed from r/piracy to make sure there's no dodgy links that have slipped through the cracks, leaving the group at risk of another DMCA notice. That's one heck of a lot of posts given the subreddit goes back to 2009. The "nuclear option", as it's been dubbed, split moderators so was voted upon by the community.

But who is going through years-old posts looking for links to pirated content? Perhaps Warner Bros spotted a rise in piracy of slightly older films, but there could be another explanation: the rights holder lawyered up or signed on to a content protection company. "It does look to me as if this is a change in strategy," Woods says, and could point to the use of rights protection companies that seek out online piracy, filing DMCA takedowns on behalf of rights holders regardless.

It's unclear if that's what's happened here, as not all of the notifications have been made public. That said, Woods notes that most rights holders will be focused on piracy that costs them. "Their efforts will be focused on the things that are genuinely causing harm," he says.

And there is plenty of financial motivation as piracy does impact the industry, but depending on whose research you look at, piracy is either falling or on the rise — though so too are industry revenues.

Figures from Sandvine's Global Internet Phenomena report suggest streaming and torrents are both climbing, though recent figures from MUSO suggest a slight drop in piracy. But revenue for the music industry is increasing, after plateauing five years ago.

What's changed? Streaming. According to the Record Industry Association of America's figures , released in February, revenue from streaming music was up by a third to $7.4 billion in 2018 — making up three-quarters of all revenue for the US music industry and most of its growth. Movie box office and TV advertising have both dipped, but that's as Netflix and other streaming sites grow, overtaking pay TV in the UK last summer.

Regardless of the motivations, rights-holders hunting down years' old infringements makes it difficult to have online discussions about piracy. People who want to chat about the merits and politics of piracy are fairly likely to also be pirates — it sort of goes with the territory.

But if users keep sharing links, and the best efforts of bots and human moderators can't catch them all, then such groups will inevitably become the target of DMCA notices. Reddit might not mind if r/piracy fails to walk that balance, suggests moderator dbzer0. "We feel this is because Reddit is trying to attract more advertisers and having a community where copyright infringement is not just discussed, but celebrated, looks bad — even though we're simply discussing the topic."

Conspiracy theories thrive on Reddit, but it's certainly true that formerly subculture spaces on the internet are becoming more mainstream — look at Tumblr, with its ban on porn .

"People need to be aware as always that Reddit is like any mainstream 'apolitical' corporation. It pays lip service to noble goals like free speech and so on while it's small and trying to attract users. But now that it became large, we are all finally the product it's trying to sell to advertisers," says moderator dbzer0. "So anything that is controversial towards the mainstream will slowly inch towards the chopping block. Today it's /r/piracy, tomorrow it might be r/anarchism ."

Whether or not Reddit is actually cleaning house or merely acquiescing like plenty of others on the web to the DMCA system, if r/piracy is banned, its members already have a list of forum replacements, including rival discussion site Raddle.me. Indeed, those ten years of r/piracy posts aren't actually gone; they've already been archived on GitHub. Piracy might move away from Reddit, but that doesn't mean it's dead. As dbzer0 puts it: "I do not worry about pirates — like the many-headed hydra, we will always respawn harder to kill."

Movie companies have lost a third attempt to unmask Reddit users who posted comments discussing piracy. In an order on Wednesday, the US District Court for the Northern District of California rejected movie copyright holders' demand for seven years' worth of "IP address log information" on six Reddit users.

In a motion to compel that was filed last month , movie companies Voltage Holdings and Screen Media Ventures argued that "Reddit users do not have a recognized privacy interest in their IP addresses." But in Wednesday's ruling, US Magistrate Judge Thomas Hixson said, "The Court finds no reason to believe provision of an IP address is not unmasking subject to First Amendment scrutiny."

Voltage Holdings and Screen Media Ventures previously sued the Internet service provider Frontier Communications, alleging that it is liable for its users' copyright infringement. Seeking evidence for that case, the movie companies subpoenaed Reddit in an attempt to prove that Frontier has no meaningful policy for terminating repeat copyright infringers and that this lack of enforcement drew customers to Frontier's service.

"Reddit argues the Court should deny the motion because it is an unmasking subpoena, targeting a potential witness rather than a potential defendant, and is therefore subjected to First Amendment scrutiny," Hixson's order noted. Reddit also argued that the evidence sought by movie companies can be obtained instead from Frontier and from Frontier subscribers.

Hixson's order, which was previously reported by Torrent Freak, said that courts use a "higher standard for unmasking a non-party witness" than for potential defendants because "litigation can often continue without interfering with a non-party witness's First Amendment right to anonymity."

Reddit can protect First Amendment rights of users

The ruling is similar to previous ones in which the same court denied movie-industry attempts to unmask Reddit users. The fact that movie companies only sought IP addresses instead of names this time around wasn't enough to sway the court.

The previous cases are being called Reddit I and Reddit II . Voltage Holdings was one of the copyright holders involved in Reddit I , while both Voltage Holdings and Screen Media Ventures were involved in Reddit II .

Hixson referred to the prior cases in this week's ruling, saying the third is similar in part because the "court adjudicating the copyright litigation has already ruled [the movie companies] can obtain identifying information from Frontier for IP addresses known to have pirated using Frontier's network." As in the previous cases, the movie companies "cannot show that the information they seek here is unavailable from other sources," Hixson wrote.

Voltage Holdings and Screen Media Ventures cited Reddit posts in which users say that Frontier didn't terminate their Internet service despite sending many copyright infringement notices about torrent downloads. One of the users wrote, "I got a total of 44 emails from frontier about downloading torrents and that it could terminate service. They haven't yet. And I kinda feel like if they didn't do it after 44 emails. That they won't… ."

The movie companies argued that getting these Reddit users' IP addresses is relevant and proportional to the needs of the case because the comments support the allegation "that the ability to pirate content efficiently without any consequences is a draw for becoming a Frontier subscriber... and that Frontier does not have an effective policy for terminating repeat infringers."

But Reddit has the right to refuse to provide that information, Hixson decided. "The Ninth Circuit has recognized that Internet platforms can assert the First Amendment rights of their users, based on the close relationship between the platform and its users and the 'genuine obstacles' users face in asserting their rights to anonymity," Hixson wrote.

With new streamers constantly launching and lockdowns changing watching patterns, film and TV piracy is mounting a comeback. Can anything be done?

I n the 2000s, I arrived at university to vast libraries, thousands of strangers and the riches of academic life – plus a gigabit broadband connection that would be used on downloading pirated versions of every piece of entertainment ever made. In between essays, I watched classic movies, listened to vast discographies, and binged the entire run of Buffy the Vampire Slayer . That particular choice might mark this story out as one that belongs firmly in the past, but piracy itself is far from dead.

We are living in a golden age of streaming. Netflix , Disney+, Amazon Prime Video and Apple TV+ are pumping out award-winning shows. Britain’s public service broadcasters have more box sets than you can consume in a lifetime. If you have a niche interest, someone is streaming it for you somewhere: Sony’s Crunchyroll for anime fans, BFI Player for film buffs, Sky’s History Play for those who really like ancient aliens. And even before the pandemic forced film studios to experiment with simultaneous cinema and home releases, we had access to more films and shows than any other point in history.

But as the new releases keep coming, the bills start growing. If your interests are decidedly mainstream, the basic tiers of the five largest paid-for streaming services in the UK – the aforementioned US giants, plus Sky’s Now TV – will cost you almost £40 a month. Drop any one of them, and you will inevitably miss out on the pop culture craze of the month: no Now TV means no The White Lotus ; no Disney+ means no Marvel.

So it is no wonder that an increasing number of viewers are turning, or returning, to less legitimate services. In 2021, we’re no longer reminded that we “wouldn’t steal a car” on anti-piracy adverts, but piracy never went away – and it’s now more appealing than ever.

This wasn’t how it was supposed to be. Piracy was meant to follow the path set by the music industry: where technological change initially enabled new forms of copyright infringement, then spurred rejuvenation, settling into a new equilibrium.

Napster, and then peer-to-peer filesharing, were the innovations that rocked music. Global recorded music sales peaked in 1999, at $25.2bn, then bottomed out 14 years later at barely half that. Illegal downloading wasn’t just cheaper than buying CDs, it was also more convenient than traipsing to the high street. But music streaming, arriving with the launch of Spotify, changed everything. Streaming meant instant access and a better user experience than piracy. Where legal downloads peaked at 27% of the industry’s total revenue in 2014, last year streaming made up 62% of music revenue , with 2020 seeing the highest earnings since 2003.

The hope was that the film industry would repeat music’s success in tackling piracy. The shift from VHS to DVDs to Blu-rays wasn’t as phenomenally successful for film and television as the CD boom was for music; cinema and broadcast rights still made the lion’s share of revenue. But when download speeds increased, piracy became an ever bigger problem.

“In any phase of technological development, you see rapid changes in the illegal market, which are quicker than the changes in the legal market,” says Kieron Sharp, chief executive of the UK anti-piracy group Fact (it of the “You wouldn’t steal a car” adverts). “If you don’t continually fight the pirates and those stealing your content, it’s going to be a bit of a free-for-all.”

Video piracy, which had been a matter of low-level criminal gangs selling counterfeit DVDs on the street when Sharp joined Fact, boomed in the late 00s. The legal market quickly responded: former DVD-subscription service Netflix began streaming in January 2007, while BBC’s iPlayer launched by the end of the same year. It seemed the video industry would follow music’s path: disruption, response, equilibrium. But over the last decade, the differences between the two sectors have become clear, and the blame could lie with House of Cards.

Netflix’s 2013 adaptation of the Michael Dobbs novel starring Kevin Spacey was the streaming service’s first in-house production, and an enormous hit. Winning three Emmys, it suggested a future for the streaming service very different from that of Spotify, still two years from facing its first serious competition in the form of Apple Music. Where music streaming services competed to have the fullest libraries possible, Netflix leaned hard on having exclusive, acclaimed shows. As a business strategy, it paid off. For Netflix, and the other streaming services that followed, the upfront cost of an exclusive show is huge – but so is the incentive for new users to hop on board.

That is until the system breaks down. Andy Chatterley, chief executive of the piracy analytics firm Muso, thinks this began in the pandemic: “In 2020 there was this massive increase in piracy at the start of the pandemic, where everyone suddenly found themselves working from home. That’s unusual – we normally see big spikes up on things like 1 January, holidays, but the average is smooth.”

Chatterley’s data, gathered across a range of piracy sites, shows a prominent bump in the first few months of lockdown (driven, interestingly, by a huge increase in weekday piracy as the days of the week blurred into one). But the real change came in 2021, when studios and channels began to realise they couldn’t hold all their new releases for cinemas to reopen.

The tale is less one of demand than of supply. For movies, piracy had typically been kept at bay while the film was in cinemas, and viewers had to either pay, or settle for a fuzzy version recorded on a hidden camera. But the pandemic broke that pattern: films such as Black Widow , Godzilla vs King Kong and Wonder Woman 1984 , released on streaming days after they hit the few cinemas left open, drove incredible traffic to piracy sites.

But if the pandemic and a fragmented market are driving people to piracy, it is having less of an impact on what they’re watching. Muso’s data shows that the most popular pirated shows in the UK in July included a few that are available on free-to-air TV, such as Rick and Morty and Love Island . Yes, Disney+ exclusives such as Loki and Star Wars: The Bad Batch are in the Top 10, as is the CW hit Superman & Lois, which is still yet to be legally available in the UK. But the data suggests people are choosing to pirate first, and what to watch second. That’s not surprising, Chatterley says, given the ease of modern piracy. “When people actually apply piracy, they’re completely satisfied in their viewing experience. They’re using a streaming platform with extremely sophisticated user experience.”

And after just a few years of streaming, we now have streaming fatigue: too many different services and not enough time. The problem is particularly acute in the US, where many big broadcasters have brought out their own streaming services – HBO Max, Paramount+ and NBC’s Peacock – each with monthly fees to pay. Analysts are predicting a wave of failures and consolidation over the next few years, likely to drive even more piracy.

Until then, over at Fact, Sharp will continue to fight against a seemingly unending tide. Where the industry has had some success in the courts shutting down large piracy sites, the breadth of the problem film and TV are facing can been seen in another corner of the streaming world: sport. According to an Office for National Statistics (ONS) survey, more than a third of those who watch live sports online do so illegally. The time pressure for finding and stopping such streams when a match is on is intense. “You’d send takedown notices to people whose services were offering the live sport, and the live sport was over by the time they were down,” Sharp says. “So things have got to improve there.”

When there are things to pay for, there will always be people looking for ways to get them for nothing. The question now is whether, having come so close to being pushed underground, piracy could rear its head not as the only option for thieves but as the simpler alternative for everyone.

If you're caught illegally streaming videos online, you could face a fine of $750 or more, according to criminal defense attorney Matt Huppertz in Waukesha, Wisconsin.

For example, in August , the FBI charged eight men with a range of crimes including conspiracy to violate criminal law and copyright infringement by reproducing and distributing video illegally obtained through several torrent websites.

Two of the men have since pleaded guilty. 

And two business partners in California were reportedly criminally prosecuted in November for selling illicit streaming devices. The distribution or the reproduction of licensed content is a felony, according to the Copyright Office.
