In a significant update for international students in Canada, Immigration, Refugees and Citizenship Canada (IRCC) introduced new eligibility requirements for Spousal Open Work Permits (SOWPs) on March 19, 2024. Previously, spouses of international students generally qualified for SOWPs. However, the current system implements a more selective approach:

  • Eligibility for Spouses/Common-Law Partners Applying After March 19, 2024

This category applies to applications submitted on or after the aforementioned date. Here, eligibility hinges on the student spouse’s enrollment in a professional degree program at a university (master’s or doctorate) or a polytechnic institution offering programs like:

  • Doctor of Dental Surgery (DDS, DMD)
  • Juris Doctor or Bachelor of Law (LLB, JD, BCL)
  • Medical Doctor (MD)
  • Doctor of Pharmacy (PharmD) or Doctor of Optometry (OD)
  • Veterinary Medicine Doctor (DVM)
  • Nursing Bachelor of Science (BScN, BSN, BNSc)
  • Education Bachelor’s Degree (B. Ed.)
  • Engineering Bachelor’s Degree (B. Eng., BE, BASc)

To support the application, the spouse/common-law partner must provide proof of enrollment, such as a valid Letter of Acceptance (LOA) or transcripts from the Designated Learning Institution (DLI).

Important Note for Pre-March 19, 2024 Applicants

Spouses/common-law partners who submitted applications before March 19, 2024, may still be eligible under the previous criteria. This includes situations where:

  • The student spouse holds a valid study permit.
  • The study program qualifies for a Post-Graduation Work Permit (PGWP).
  • The student is enrolled full-time at a designated educational institution (public post-secondary schools, CEGEPs in Quebec, or authorized private institutions).

Extensions and Validity

The duration of a spousal open work permit typically aligns with the validity period of the student spouse’s study permit.

A spouse or common-law partner of a skilled worker or international student in Canada can apply for an open work permit, allowing them to work for any employer in Canada without first having a job offer. The type of work permit your spouse is eligible for depends on your own status in Canada.

Your spouse can usually apply for an open work permit if you :

  • Are an international student at a postsecondary institution
  • Hold a work permit for a skilled job (NOC 0, A, or B)*
  • Are allowed to work in Canada for at least six months
  • Skill Level A (Usually requires a University Degree) 
  • Skill Level B (Technical Jobs/ skilled trade jobs- usually require a College Diploma)
  • Skill Level 0 (management duties) 

The spouse can apply for the work permit before or after arriving in Canada. The application can be submitted in two ways:

As part of the application, include details and documents related to the primary applicant’s status. These may include:

  • Copy of the study permit
  • Work permit
  • Employment details
  • Proof of student enrollment (at a Canadian institution)

  • Completed Application Forms
  • (if applying from outside Canada), and Application to Change Conditions or Extend Your Stay in Canada [IMM5710] (if already in Canada).
  • Passports, marriage certificates, and birth certificates for any dependents.
  • Marriage certificate or evidence of common-law status.
  • Copy of the study permit or work permit of the spouse in Canada.
  • Evidence that the primary applicant can support the family financially during the stay.
  • Though not necessary, if the spouse already has a job offer, including the details can be beneficial.
  • Receipt for the payment of the application fee.

Eligibility

Your spouse or common-law partner may apply for an Open Work Permit if you are a full-time McGill student, you have a valid Study Permit and you are studying in either:

  • a master’s or doctoral degree program in a university or polytechnic institution, or
  • Doctor of Dental Surgery (DDS, DMD)
  • Bachelor of Law or Juris Doctor (LLB, JD, BCL)
  • Doctor of Medicine (MD)
  • Doctor of Optometry (OD)
  • Pharmacy (PharmD, BS, BSc, BPharm)
  • Doctor of Veterinary Medicine (DVM)
  • Bachelor of Science in Nursing (BScN, BSN, BNSc)
  • Bachelor of Education (B. Ed.)
  • Bachelor of Engineering (B. Eng., BE, BASc)

Your spouse/partner will not require a job offer to apply, and his/her permit will be valid for the same period as your study permit. The work permit must be obtained prior to employment.

INSTRUCTIONS - HOW & WHERE to APPLY

  • You can check IRCC to find out how long it will take before the Open Work Permit application is processed. Processing times vary according to volume and time of year.
  • Apply using the IRCC Secure Account (GCkey) for the Open work permit.

Applying from outside of Canada

Applying from inside of canada, applying at the border, applying upon arrival to canada.

  • Scenario A: Together with your Study Permit Application OR
  • Scenario B: Separate from your Study permit Application

For the two above scenarios, you would apply online.

Applying Online

1. start by filling out the check your eligibility to apply questionnaire..

  • If applying together with your study permit application, enter that you would like to study in Canada. Answer Yes to the question “ Do you want to submit an application for a family member ?”. Answer Work with an Open Work permit to the question “ Why is your family member visiting Canada?”.
  • If your spouse/common-law partner is applying separately, they must enter that they would like to work in Canada. Answer No to the question “ I have a job offer and my employer gave me an offer of employment number or LMIA number”. Answer Yes to the question “Are you a spouse or common-law partner of a person who holds a study permit”

2. Write down the personal reference code you are given at the end of the questionnaire.

3. log into your ircc secure account (or register for an account - also known as a "gc key" - if you don't have one already), 4. complete the pdf application form provided.

  • Save it to your desktop, and upload it to your application (the electronic signature is not needed).
  • No job offer is necessary when applying for a spousal work permit. You can indicate "not applicable" in fields requesting this information.
  • No Labour Market Impact Assessment (LMIA) is necessary for the above work permits; you can leave this section blank.

NOTE: McGill's Designated Learning Institution number (DLI#) is O19359011033

5. Upload required documents

  • Upload your saved IMM5710 form to your application
  • When asked to upload your passport, be sure to include ALL stamped/marked pages of your passport. These should all be scanned into 1 document.
  • If you were required to do a medical exam as part of your work permit application, upload proof of this (i.e. a receipt) in the additional documents section.  

6. Pay the required fees:

  • Spousal work permit = $155 + $100 fee = $255

7. Wait to receive your online work permit approval notice (Letter of Introduction).

  • You can check your IRCC Secure Account to find out how long it will take before you get your Work Permit. Processing times vary according to volume and time of year.
  • Having problems with your CIC online application? Contact your visa processing office.
  • Scenario: Your spouse has entered Canada as a visitor, and now wishes to apply for an Open Work Permit

1. Your spouse/common law partner can start their online application by filling out the Check your eligibility to apply questionnaire.

  • Your spouse or common law partner must enter that they would like to work in Canada. Answer No to the question “ I have a job offer and my employer gave me an offer of employment number or LMIA number”. Answer Yes to the question “Are you a spouse or common-law partner of a person who holds a study permit”

2. Write down the personal reference code that is given at the end of the questionnaire.

3. your spouse/common law partner must log into their ircc secure account (or register for an account - also known as a "gc key" - if they don't have one already).

  • Be sure to include your UCI (Universal Client ID - which can be found on your Study Permit)
  • If you were required to do a medical exam as part of your work permit application, upload proof of this (i.e. a receipt) in the additional documents section.
  • Having problems with your CIC online application? Contact the Immigration Canada Call Centre at 1.888.242.2100

In light of the announcement that international students may no longer apply for the post-graduation work permit (PGWP) at the border, we suggest that spouses apply for their Open Spousal Work Permit online.

You may still try to apply at the border by flagpoling however there is no guarantee that a border officer will process your application.

  • Scenario: Your spouse has entered Canada as a visitor, and now wishes to apply for an Open Work Permit at the border or port of entry. 

Although we cannot guarantee that your application will be processed, you may try to apply for your work permit (spousal) at the border or port of entry if you are TRV-exempt, meaning either:

  • You are a citizen of a TRV-exempt country, OR
  • You are a citizen of a TRV-required country and are re-entering Canada solely from the US

The closest land borders that process work permits are:

  • Lacolle/Champlain
  • St. Armand/Phillipsburg
  • Montreal's Trudeau Airport - but only if you are flying into Montreal from an international destination.

Don't forget to bring:

  • Valid Study Permit - belonging to the full-time McGill Student
  • Proof of enrolment and current transcripts - belonging to the McGill Student
  • Immigration Canada application fee: $155 + new $100 fee (as of Feb. 21, 2015) = $255
  • All of your supporting documents: proof of medical exam (if applicable), Marriage License/Certificate (translated in either English or in French) or proof of common-law partnership .  
  • Scenario: Your spouse/common law partner is from a TRV-exempt country. They will be able to apply for the Open Work Permit for Spouses at any port of entry.

Applying at a Port of Entry

Although we cannot guarantee that your work permit (spousal) will be processed, you can try to apply for the open spousal work permit upon your arrival to Canada, if you are:

  • You are a citizen of a TRV-exempt country
  • All of your supporting documents: proof of medical exam (if applicable), Marriage License/Certificate (translated in either English or in French) or proof of common-law partnership .

Once you find a specific job posting that you want to apply for, you can begin to work on your application cover letter. Following these steps before you begin will help you write the best cover letter possible.

1. Do Your Research

Before you begin to write your cover letter, learn everything that you can about the company or organization you are applying to. Check out their website and social media pages, research their top competitors, and read recent industry news articles. Learn the name(s) of the individual(s) who will be in charge of hiring for the position you want, as well as the head(s) of the company.

Also, keep in mind the job description and requirements for the role. it allows you to create a cover letter that showcases your qualifications, aligns with the company’s needs, and demonstrates your genuine interest in the position. Keep a library of snippets or bullet points highlighting your achievements, skills, and relevant experiences. You can easily insert these into your cover letter as needed. This template can serve as a foundation for various job applications, making the process more efficient.

Formatting Guidelines

There is a standard cover letter format that most Canadian employers will expect you to follow. However, depending on your industry and the specific job posting you are responding to, you may have to change the formatting of your cover letter.

1. Length  Your cover letter should be no more than one page in total.

2. Font  Your font should be consistent throughout your cover letter, and you should choose a professional-looking font. Your font size should be big enough that it is easy to read when your cover letter is printed.

3. Spacing  Your cover letter should be appropriately spaced. The main body should be single-spaced, with sufficient space left between each new paragraph and section.

What to Include

There are seven sections in a cover letter.

1. Your Information  Your name and contact information should be at the top of your cover letter. Include your:

  • First and last name
  • Current residential address
  • Phone number
  • Email address

2. Date  Below your information, write the date that you are sending your cover letter.

3. Employer Information  Below the date, include the contact information of the individual, department, or company you are addressing in the cover letter. If you know the name of the individual, include their:

  • Position title
  • Company or organization name
  • Commercial address of the company or organization

If you do not know the name of the individual, include:

  • Department in charge of hiring decisions (if known)
  • Commercial address of company or organization

4. Greeting  Use a formal greeting to open your letter. If you know the name of the individual making hiring decisions, address them directly with their prefix and full name. If you don’t know the name of the individual, use a formal, generic greeting like ‘To whom it may concern,’.

5. Main Text:  There are three parts to the main text of your cover letter: the introduction, body, and conclusion.

Introduction  In the first paragraph of your cover letter, you should introduce yourself as a candidate . Include your first name and the position you are applying for. You can also include your post-relevant qualification and how you found the job posting. If you have a contact at the company who referred you to the job, you may want to mention him or her by name and department. Your introduction should be no more than two to three sentences.

Body  In the next couple of paragraphs, you want to convince the employer that you are the best candidate for the job position. Tell them why they should invest in you. If you’re not sure what to include, try to answer these questions:

  • What projects have you worked on that are relevant to this position? What did you learn from them? Why does this make you a better candidate?
  • What responsibilities have you held that are relevant to this position? What did you learn from them? Why does this make you a better candidate?
  • What do you intend to do if you are hired? What benefit does the employer get if he or she hires you instead of someone else?

The body of your cover letter should be one or two paragraphs.

Conclusion  The conclusion is the final paragraph in the main text of your cover letter. It is your opportunity to tell the employer how you feel about potentially working for the company, thank them for the opportunity to apply, and invite them to respond to your application. It should be no more than three or four sentences.

6. Signature  There are two parts to your cover letter signature: the closing line and your full name.

  • Closing Line  Your cover letter must include an appropriate closing line. This is the line right before your name.
  • Full Name  Your full name follows the closing line. It is not necessary to print and physically sign your cover letter since more job applications are done electronically.

Final Revision

Carefully review your cover letters to make sure you have not made any mistakes.

1. Proofread

Check your cover letter for any spelling or grammar mistakes. If possible, have someone else proofread it for you, or come back to it after a night’s sleep. Be sure that you have not made any mistakes in:

  • Your name and contact information
  • The employer’s name and contact information
  • The name of the company or organization you are applying to

2. Check Instructions

Go over any instructions for your cover letter given by the employer and make sure you have followed them carefully.

Make sure that you have the correct date on your cover letter. The date should be the day that you send your cover letter to the potential employer.

Hey all, I have read almost all the posts on this thread and I am really confused at one aspect of Spouse Open Work Permit in one specific case: The VO expects the spouse to come back with husband/wife after both of their work permits end. Period. I have read many applications refused based on family ties and intent of not returning back to Home Country. Now what happens in case when the Spouse in Canada (having a Post Graduate Work Permit and skilled job) applies for Permanent residence. The spouse is technically eligible since the "Current Status" is still Temporary worker with skilled job. But now what happens to the whole "ties in home country and coming back thing"? The cat is out of the bag. The spouse seeking Open Work Permit has no intentions of coming back. That's plain as day, and no point trying to convince the VO otherwise. How does this whole thing works in situations like these? Should I call cic and inquire?

hi guys, just a quick question: i'm currently working here in canada as a temporary foreign worker. we've applied for an open spousal work permit for my wife last year. if my wife has already received her Letter of Introduction (LOI) from the visa office saying that she's already approved to work in canada, does that mean she can already come here? based from what i read at the cic website, her actual work permit will be provided at the border when she arrives, right? also, she doesn't need a positive LMIA or an employment offer letter since she's applied under OSWP, right? what other documents does she need to present when she arrives at the border? thanks in advance for all the response!

hi fkl, thanks for your prompt response. so when my wife gets the LOI, she'll need to have her passport sent to the visa office for the TRV stamp? would you know how long is that going to take?

fkl said: Hi Lawliet, You are most welcome. No LOI is the last step towards local embassy processing. The process and time might vary depending upon you home country and embassy. But generally if you applied on paper, you would submit original passport as part of application so visa stamp will come along when you receive approval. If you applied online and only submitted a passport scan (and need visa to enter Canada), you would receive a passport request from CIC. At this stage you should be fairly confident of visa approval. Far fewer rejections happen AFTER passport request. In India / Pakistan (the two embassies i know of) People usually get LOI 15-20 days after sending passports back. It doesn't say LOI any where. It just says "Your application to work/study in Canada has been approved" along with other details. Hope that helps Click to expand...

Hello FKL I applied SOWP at VFS Bangalore 2 months back. So for no updates even for medical call. The website it has been mentioned that it takes 2 months to process. Should I write a mail to CIC or should I wait? We are worried about longer delay. Vishwa

  • You’re a Ukrainian national or an accompanying family member of a Ukrainian national.
  • You have a valid study or work permit.

When you fill out the work permit application form

To get priority processing, follow these steps:

  • offer of employment  or
  • labour market impact assessment (LMIA)
  • This is box 4 in the  Details of intended work in Canada  section.
  • You must enter only the number .

On November 16, 2022, we switched to the 2021 version of the NOC system.

If you apply for a work permit on or after November 16, 2022, make sure you use the NOC 2021 codes .

Inside Canada – Not eligible: Apply online under a public policy

Normally, visitors can’t apply for work permits from inside Canada. Due to a temporary policy change, visitors can apply online for an  employer-specific work permit  by following the steps below.

Who’s eligible

  • You must stay in Canada while we process your application. If you leave while your application is being processed, you won’t be eligible under this public policy.
  • Applications submitted before or after these dates are not eligible.
  • If your visitor status has expired, you’ll need to restore your visitor status before you apply for a work permit.

If you’re a visitor in Canada, you’re not eligible to apply for work permit with a labour market impact assessment (LMIA) to work as a caregiver in either of the following National Occupational Classifications (NOC):

  • NOC 44101 (Home support workers, caregivers and related occupations)

If the printed expiry date has passed and you’re applying for a visitor visa, study permit, work permit or to extend your stay as a temporary resident in Canada, follow these steps:

  • Add 5 years to the printed expiry date shown on your passport and enter it in the expiry date field of the application form.
  • Include a letter of explanation with your application stating: “I am a Venezuelan national with a Venezuelan passport, which has been extended for 5 years”.

Warning: If your passport is still expired after adding 5 years to the printed expiry date, your passport is considered expired. You’re not eligible to submit an application with that passport.

Credit cards and prepaid cards

We accept credit cards and prepaid cards from:

  • MasterCard ®
  • American Express ®
  • UnionPay ®  (for online applications only; debit cards not accepted)

If you use a prepaid credit card, keep it for  at least  18 months after you pay to make refunds easier.  Find more on prepaid cards .

We also accept all Visa Debit cards.The card you use doesn't have to be in your name. The cardholder’s name will appear on the receipt but it does not need to match your application.

Debit cards

  • be from a Canadian bank using  INTERAC ®  Online , and
  • be registered for online banking through your bank’s website.

We also accept all Debit MasterCard ®  and Visa ®  Debit cards. If your card has the Visa Debit logo on it, alone or with the INTERAC ®  Online logo, select Visa Debit as your payment method.

The card you use does not have to be in your name. The cardholder’s name will appear on the receipt but it does not need to match your application.
